The Plaintiff is a GP who sustained significant injuries.
This was as a result of a loose horse landing on the roof of the car which he was driving crushing the roof and trapping his head between the roof and the side pillar of the car. He sustained significant injuries including fractures to his neck and upper back. He subsequently developed post- traumatic stress disorder. After a hearing in the High Court lasting three and a half days a judgement was handed in down in favour of the Plaintiff in the sum of €668,000. An appeal was brought to the Supreme Court by the Defendants seeking a stay on the decree pending the hearing of the substantive issue which was unsuccessful. The case ultimately settled on terms very favourable to the Plaintiff.
